66% of the people who voted know someone who lost job in this Marker, I was in US when dot-com burst happened, But even then I don't think it was as bad as this time around.
Worst part is every one I talk to says that worst is still to come. If it is so bad now , I don't know what it will be like when it is "worst". Scary situation. Even if you forget about GC, Getting a job and holding on to the job will be difficult.

From the text I can derive two conclusion either it is directed to undocumented worker or everyone is put in same basket nothing specific about our cause. Apu dont get me wrong I apprerciate your initiative but it should not happen we sign to support Kennedy he comes out as hero for Latino community (did I forget to mention political gain) and we remain where we are and watch those illegals immigrant become US citizen.

I have a full time offer from a county school (non - profit), that is related to an institution of higher education. (submitted an agreement between the school and the univ)
got an RFE, asking for 'substantiating documentary evidence that the beneficiary is enrolled in the program with the univ' ; This exemption cannot be claimed for other employees of the nonprofit in or through this jointly managed program.
Is it necessary that the beneficiary should be enrolled in agreement or a mere relationship is not sufficient???
Any suggestions....

Congress created the H-1B program in 1990 to enable U.S. employers to hire temporary, foreign workers in specialty occupations. The law capped the number of H-1B visas issued per fiscal year at 65,000. Since then, the cap has fluctuated with legislative changes. Congress asked GAO to assess the impact of the cap on the ability of domestic companies to innovate, while ensuring that U.S. workers are not disadvantaged. In response, GAO examined what is known about (1) employer demand for H-1B workers; (2) how the cap affects employer costs and decisions to move operations overseas; (3) H-1B worker characteristics and the potential impact of raising the cap; and (4) how well requirements of the H-1B program protect U.S. workers. GAO analyzed data from 4 federal agencies; interviewed agency officials, experts, and H-1B employers; and reviewed agency documents and literature.
In most years, demand for new H-1B workers exceeded the cap: From 2000 to 2009, demand for new H-1B workers tended to exceed the cap, as measured by the numbers of initial petitions submitted by employers who are subject to the cap. There is no way to precisely determine the level of any unmet demand among employers, since they tend to stop submitting (and the Department of Homeland Security stops tracking) petitions once the cap is reached each year. When we consider all initial petitions, including those from universities and research institutions that are not subject to the cap, we find that demand for new H-1B workers is largely driven by a small number of employers. Over the decade, over 14 percent of all initial petitions were submitted by cap-exempt employers, and only a few employers (fewer than 1 percent) garnered over one-quarter of all H-1B approvals. Most interviewed companies said the H-1B cap and program created costs, but were not factors in their decisions to move R&D overseas: The 34 H-1B employers GAO interviewed reported that the cap has created some additional costs, though the cap's impact depended on the size and maturity of the company. For example, in years when visas were denied by the cap, most large firms reported finding other (sometimes more costly) ways to hire their preferred job candidates. On the other hand, small firms were more likely to fill their positions with different candidates, which they said resulted in delays and sometimes economic losses, particularly for firms in rapidly changing technology fields. Limitations in agency data and systems hinder tracking the cap and H-1B workers over time: The total number of H-1B workers in the U.S. at any one time--and information about the length of their stay--is unknown, because (1) data systems among the various agencies that process such individuals are not linked so individuals cannot be readily tracked, and (2) H-1B workers are not assigned a unique identifier that would allow for tracking them over time--particularly if and when their visa status changes. Restricted agency oversight and statutory changes weaken protections for U.S. workers: Elements of the H-1B program that could serve as worker protections--such as the requirement to pay prevailing wages, the visa's temporary status, and the cap itself--are weakened by several factors. with the lack of regulation on AC 21 law, each attorney's take different position when it comes to handling AC 21 cases, in my case the primary reason driven to file AC 21 is the small window of period available in getting I 485 adjudicated when the PD is current, so I don't want to loose time when the PD is current and get an RFE from USCIS and running back and forth to get the RFE responded before loosing PD, more over I took the 20 minute counselling with Murthy law firm and they advised to notify USCIS about employer change.Later I was fortunate that USCIS did not issue RFE(may be it helped USCIS by notifying them in advance and clear their doubt) and approve my I 485 when PD was current.

Issuing RFE or not is an individual decision taken by the officer. In most cases, RFE is issued when 140 gets revoked because an underlying job offer is a necessity. Even if you sent AC21 letter, as long as your 140 is still intact, the officer may chose not to issue an RFE.
Some people have received RFEs in more than one ocassion. Once when 140 was revoked and once during preadjudication process. So if for some reason USCIS decides to do a second round of preadjudication just because they have not other work or any specific reason then we may expect RFEs (This is something I made up - I don't think there will be another round of preadjudication.
Informing USCIS in advance helps rarely but maybe useful at times if you know your 140 could potentially be revoked and in a lot of cases 485 gets deined as a result. The MTR filing process can include a communication trail about informing USCIS which could be of help.

I got a Multiple Entry Stamp.. ( last week of jan 2008)
The consulate officer who interviewed me did mention that they will try to get the passport back to me next day by 3 pm but there are chances that it might take a few days...
The next day I went to pick up my passport at 3 and it was not ready..The security guy said -> "because of the new system, the stamping is taking a while. But most of the guys have got it the next day by 5 pm.. the worst case was an H1 candidate who had to comeback after 2 days for his passport...But that was the only blip ..."
I would suggest booking ur tickets as if you were to get the passport the next day, but also buy the 52$ insurance (if you buy it on Orbitz) so that you can easily cancel and re-book it...
Also I read in several posts about who could go to halifax for stamping. Its true that only revalidation candidates should schedule but
It does not matter what employer name is printed on your existing expired VISA . You just need an existing H1 approval ( stamped) which is being extended. In my case I had only an expired stamp from my first company but I had transferred the H1 Visa to 2 employers since then without their stamp.
So this stamping was for my 3rd employer.

It does not matter what employer name is printed on your existing expired VISA . You just need an existing H1 approval ( stamped) which is being extended. In my case I had only an expired stamp from my first company but I had transferred the H1 Visa to 2 employers since then without their stamp.
So this stamping was for my 3rd employer.

Thanks for the clear answer thepaew. That is what I thought. I currently have the opportunity to start the green card process with my employer under EB3 ROW, but I am also planning to go for an MBA in the US within the next few years. I am just into my 5th year of H1. It seems that I should not start the green card process if I am sure about going for an MBA in the US within the next few years. That would be terrible if you get into a school you like but cannot attend since you cannot switch from H1 to F1.

This shouldn't surprise you, should it? In the US too, some engineers make 50K and others make 200K. It depends both on prevailing standards and the individual's skills/luck/location. I do know people making ridiculous sums in India, but they are worth every cent to their employers.
It basically depends on how much value some people can add and how well they can negotiate.
I think the 3 to 4 lakh comment was meant for people "who could not get a job at Microsoft or IBM." I think that the author qualified his/her comments by stating "Not everyone gets into Microsoft or IBM india. You have to compete with MS/PhD in computer science for the same job that needs BS in big companies due to high rate of competition and unemployment."
Ok. So if I summarize, you guys are providing the following ranges:
22 Lakhs to 40 Lakhs
20 Lakhs to 35 Lakhs
12 Lakhs to 15 Lakhs
3 Lakhs to 4 Lakhs
That means, 3 Lakhs to 40 Lakhs. :)
